Boundary issues

Question from Upali Sarathchandra updated on 13th May 2010:

How do I deal with a situation like this. Property bordering on my rental property is also rented and managed by a company. Due to lack of upkeep on their side, number of trees are growing at the boundary and threatening the structure of the fence. I contacted a rental manager of the company and he seems not interested at all in addressing the situation. Tenants are not interested. These trees are not high value natives or exotics. They are undesirable trees such as privot. Thank you

Our expert Jeff Montgomery responded:

The Residential Tenancies Act 1986 applies only to the relationship between a tenant and landlord. It doesn’t cover the relationship between neighbours. If you are the owner of the rental property, I suggest you seek independent legal advice from your local community law centre concerning your situation. If you are a tenant in the rental property, I suggest talking to your landlord about addressing the situation with the owner of the neighbouring property.

To discuss your situation further, you can contact the Department of Building and Housing on 0800 TENANCY (0800 836 262).

The Department of Building and Housing provides information and guidance on building law and compliance, services including weathertight homes, and advice for tenants and landlords.
