Is there any protection from land rent increases?
Question from Mike updated on 1st August 2008:
I have an apartment in a development where we lease the land. With the land lease review coming up we are looking at 1000% land rent increase. Is there any protection from this with the tenancy tribunal? We are in a landlord/ tenant situation here?
Our expert Jeff Montgomery responded:

The Residential Tenancies Act only applies to tenancies for residential premises, and does not cover agreements to lease land. I recommend that you seek independent legal advice from your local community law centre about your particular lease agreement.
The Department of Building and Housing provides information and guidance on building law and compliance, services including weathertight homes, and advice for tenants and landlords.
