Property manager has not increased rent as asked, what can I do?
Question from Janet updated on 4th March 2009:
I have a property manager(PM) for a rental I own. I sent an email requesting the weekly rent be increased (5th Oct). PM said he would action this when received my proposed amount. I received PM's statement - new rent doesn't show up. I have allowed more than 60 days notice for the notice to take effect (meant to receive rent increase in mid Dec). PM says he never got my email and that the increase will now be on 1 Feb. Email sent on 5th shows as being delivered. What should I do to recover the rental imbalance and where do I stand on this?

The Residential Tenancies Act 1986 only applies to the relationship between a tenant and landlord. It does not cover the relationship between a property owner and property manager. I recommend that you seek independent legal advice from your local community law centre about whether you have any recourse with your property manager.
