RTA coverage

Question from Nicki updated on 1st May 2017:

Is renting a residential garage for storage covered by tenancy law? Or is there another type of agreement / law for storage at a place that is not your place of residence with different tenant / lease / landlord obligations?

Our expert Allan Galloway responded:

The Residential Tenancies Act applies to every tenancy for residential purposes, except in certain instances described in the Act. For example, if you are renting a garage separately for storage only, rather than as part of a house and section, then this agreement would not be covered under the Act.

You can seek advice on this type of non-residential arrangement from a lawyer or agency such as a Community Law Centre or Citizens Advice bureau. For information on the rights and responsibilities of landlords and tenants who are covered by the Act, go to www.tenancy.govt.nz or subscribe to our e-newsletter Landlord News at www.tenancy.govt.nz/subscribe.

The Ministry of Business, Innovation and Employment provides information and guidance on building law and compliance, services including weathertight homes, and advice for tenants and landlords.
