Sanitary concerns

Question from Neil updated on 10th April 2013:

How do we get a property survey report to find out if rented accommodation is unsanitary or not? Who would we contact in Papakura, Auckland?

Our expert Alan Bruce responded:

Under the Residential Tenancies Act (the Act), landlords are responsible for ensuring that the premises comply with all the relevant health, safety and building regulations that apply to the premises. They are responsible for ensuring that the premises are maintained in a reasonable state of repair, having regard to the age and character of the premises. To determine whether a property complies with all the relevant health, safety and building regulations, you may wish to contact your local council. To discuss your situation further or any questions you may have about a landlord’s responsibilities (including maintenance), you can visit the Ministry of Business, Innovation and Employment's building and housing group’s website (www.dbh.govt.nz) or call 0800 TENANCY (0800 836 262).

The Ministry of Business, Innovation and Employment provides information and guidance on building law and compliance, services including weathertight homes, and advice for tenants and landlords.
