Selling without an agent?

Question from Simon updated on 30th June 2011:

Our current tenant is managed by a property management company (also a real estate agency). She has contacted us privately (through a mutual friend) and wishes to purchase our home. Can we begin this process without involving the property/real estate agents involved?

Our expert Juliet Robinson responded:

I think the real question you are asking is whether you can negotiate the sale of your house to your tenant without involving the real estate agent. Presumably you have not engaged the real estate agent to sell your property for you, and so as long as the agent has not introduced the purchaser to you as a potential purchaser, you are free to negotiate privately.

Be aware, though, that at some stage you will need to commit an offer and acceptance to writing. You should both take professional legal advice before signing any such agreement.
