Shared fence issues

Question from Chris updated on 24th April 2017:

My property adjoins a shared driveway leading to four properties. The fence between my property and the shared driveway needs repair, and I believe that in accordance with the Fencing Act, the costs of repair may be shared. My question is in what proportion should these costs be shared - considering the multiple nature of the shared ownership of the driveway?

Our expert Bernard Parker responded:

The Fencing Act specifies the proportions to be paid by landowners on adjoining sides of a proposed fence. It also specifies a process for obtaining agreement between neighbours as to what type of fence is to be built. Rather than give you an answer, I would direct you to read the Fencing Act. It can be found online at www.legislation.govt.nz. If you need further advice you should consult your lawyer or a Community Law Centre.
