Tenancy Tribunal decisions?
Question from Philippa updated on 13th December 2013:
Section 40(3A)(d) of the Residential Tenancies Act (RTA) states harassment of tenant or neighbour is an unlawful act. Has anyone, in your knowledge, ever been fined for harassment of neighbours and how can I find out details please? The Tenancy Tribunal orders online only provides for searches under names or addresses and not under sections of the RTA.
Our expert Alan Bruce responded:

The Ministry of Business, Innovation & Employment does not have a database of information about specific Tenancy Tribunal decisions.
As you mentioned, Tenancy Tribunal decisions are available online through the Ministry of Justice’s website (https://forms.justice.govt.nz/search/TT/), which can be searched using the name of a landlord or tenant, and/or the address of a residential tenancy (or by using the Tribunal’s application number if this is known). Not all orders are made public, and records may be accessed online for 36 months following the hearing.
For further information about obtaining copies of Tenancy Tribunal decisions, you may wish to contact the Ministry of Justice directly (0800 268 787).
