Weed management

Question from Jonathan updated on 27th December 2018:

In my tenancy agreement, it states that the tenants are responsible for gardening and weeding. The weeds at the property are bordering upon unmanageable and I have asked them to do the weeding. They've stated that they will do the weeding if I buy weedkiller. Is this something I need to pay for, or is it included in the conditions of the contract?

Our expert Bernard Parker responded:

Where a tenant is responsible for weeding, they must take care of the total job. Usually weeding involves removal of weeds, and it doesn’t have to include using weed killer. Just as a tenant can mow lawns or pay somebody to do the job, the same applies to garden weeding. They cannot impose any costs on the landlord for weed killer.
